1. How do you keep up to date with legislation? How does an employer know they’re being compliant if no-one has proactively told them if the laws have changed?
2. Has anyone in your organisation measured hidden costs such as labour turnover, absenteeism, lateness etc?
– If the business doesn’t have a personal leave , sickness policy, how can they effectively manage absenteeism and the resultant costs to the business?
3. How much is currently spent on legal advice / representation / awards / settlements?
– Do they engage a solicitor on a reactive or proactive basis? What are the costs involved?
4. Do you have someone looking after your HR or WHS?
5. Do you have employee documentation in place or the business including contracts, a health and safety system and a employee handbook?
• Who produced them, when and who updates them?
• What qualifications do they have?
• When are they issued?
6. Have you got any current staff issues?
– Could they have been avoided by having documentation in place along with the correct advice on how to deal with it?
7. Are you planning on increasing your number of employees?
– More employees = more risk (need to define what those employees roles will be eg – casual v permanent part time v contractor) and the documentation needs to reflect these roles? What award do those employees fall under and what entitlements are under that award? etc…
8 . What are you biggest concerns as an employer?
